1. Warranty period

GOMM PRODUKT d.o.o. warrants all Products manufactured and Services performed by us for a period of one (1) year from the date of delivery (for Products) or completion (for Services), against defects in material and workmanship attributable to us.

2. What the warranty covers

Within the warranty period, we will remedy defects in material or workmanship that existed at the time of delivery and that arise under normal, intended use. Our remedy, at our discretion, is to repair, replace, or issue a credit for the affected Product or Service.

3. What the warranty does not cover

The warranty does not apply to:

• normal wear and tear, or consumable/wearing parts;
• damage from improper use, overloading, incorrect installation, inadequate maintenance, or use outside the intended purpose or agreed specification;
• defects arising from Specifications, drawings, or materials supplied by the Customer (see Terms, Section 5);
• modifications, repairs, or interference carried out by anyone other than GOMM PRODUKT or a party authorized by us;
• damage caused by transport, accident, or external factors after risk has passed to the Customer;
• corrosion, wear, or deterioration resulting from operating conditions outside those agreed.

4. How to make a warranty claim

To make a claim, contact us at [email] within the warranty period and without undue delay after discovering the defect, providing:

1. the order/invoice number and delivery date;
2. a description of the defect, with photographs where possible;
3. the conditions under which the defect appeared.

We will assess the claim and, where valid, arrange repair, replacement, or credit. We may require the affected item, or a sample, to be returned for inspection.

5. Remedies and limits

Our obligations under this warranty are the Customer’s exclusive remedy for defective Products or Services. Liability beyond this warranty is limited as set out in the Terms and Conditions (Section 11). This warranty does not cover indirect or consequential loss.

6. Statutory rights

This warranty is granted in addition to, and does not exclude or limit, any mandatory rights the Customer may have under applicable law. In particular, where a purchaser is a consumer, statutory conformity rights under Croatian consumer-protection law (implementing EU Directive 2019/771) — including the statutory two-year guarantee period — apply and take precedence over any shorter contractual period stated above.

Practical effect: for your B2B customers the 1-year term governs. If you ever sell to a private individual, the law gives them 2 years regardless of this document — this clause makes that explicit so the warranty stays enforceable in both cases.
